Did you realize that you have likely ceded your right to a jury trial in any number of consumer contracts or employment agreements? That's right. You never had the opportunity to negotiate this type of pre-dispute waiver of your rights. This will be the third consecutive Congress that considers legislation calculated to make such waivers unenforceable (H.R. 1020) and we urge you to contact your Members of Congress and tell them you want your right to a jury trial to be protected.
The harsh reality is that as consumers and employees we cannot bargain the terms of most contracts whether they involve cell phones, investment accounts, employment contracts, leases, credit cards, nursing homes and even some doctors and hospitals. When businesses have disputes with other businesses the parties are on much more even footing and can negotiate their method of dispute resolution. The Arbitration Fairness Act of 2009 simply says that if you want to resolve a dispute by arbitration you can agree to do so but you cannot be forced to do so and your willingness to arbitrate cannot be binding on you until after the dispute arises. Mandatory pre-dispute arbitration also is rarely fair to the consumer as arbitrators are often lawyers who rely upon repeat business from the business community to earn a living. If this Act becomes law, you will get back your right to your day in court before a jury if appropriate. It's a way to level the playing field here in Connecticut and around the country.
