The Medical Malpractice Myth
by Tom Baker
Publisher: University Of Chicago Press (December 1, 2005)
Debunking the myth of the so-called medical malpractice crisis, University of Connecticut Law Professor and Director of its Insurance Law Center, convincingly and incisively dissects the arguments of those political interests that would deprive people of their constitutional right to a jury trial. Baker overwhelmingly convinces the reader that the problem is “too much malpractice” rather than too much litigation. Baker further persuades us that the crisis of medical malpractice premiums is mostly related to insurance cycles rather than runaway juries for which there is no empirical data. The debate concerning medical malpractice cannot be meaningfully pursued without Baker's help.
