Stewart M. Casper, of Casper & de Toledo LLC, recently wrote an article entitled “What Family Lawyers Should Know about Brain Injury” that has been published in Family Advocate, a quarterly publication of the American Bar Association. In this article, Casper states that family lawyers should seek and obtain the records that underlie any serious personal injury claim, such as a traumatic brain injury claim, as they are relevant and potentially material to any resolution of a marital dispute. Further, he writes, “There is certainly overlap between family law cases and personal injury cases when it comes to vocational issues and earning capacity.”
